BENSOUDA taken to task by ICC judges for claiming UHURU BRIBED WITNESSES


Thursday June 13, 2013 - International Criminal Court (ICC) Chief Prosecutor Fatou Bensouda was on Wednesday put to task by ICC judges, to prove claims on whether President Uhuru Kenyatta and former Head of Civil Service Francis Muthaura paid witnesses to recant their evidence.

These revelations are contained in an ICC ruling issued on Wednesday by Judges Kuniko Ozaki, Chile Eboe –Osuji and Robert Fremr who ordered Bensouda to contact the controversial witness 4 and obtain certain materials from him.

“The chamber notes that despite having decided not to call witness 4 to testify, the prosecution intends to rely on his statement in order to prove its allegation of bribery,” the Judges said.

Bensouda dropped the witness earlier in the year, saying he had recanted most of the evidence he had given. She had dropped charges against Muthaura saying they could no longerhold since witness number 4 had withdrawn.

When dropping Mathaura’s charges early this year, Bensouda claimed that the witness told her he had accepted bribes from one of the accused.

Bensouda, who is a Gambiannational, claimed that “persons allegedly holding themselves out as representatives of Uhuru and Muthaura” had bribed the witness.

The judges also asked Bensouda to ask witness 4 to share the email communications from the time of bribery allegations.

President Uhuru, his Deputy William Ruto and radio presenter Joshua Sang have been indicted by the ICC court in connection with 2007-08 post election violence and their trials starts later this year.
